Unified User Agreement and Privacy Policy

This Unified User Agreement and Privacy Policy (“Agreement”) is a legally binding contract between you (“User,” “you,” or “your”) and Game Arts Entertainment (“Company,” “we,” “us,” or “our”). This Agreement governs your access to and use of all mobile applications, games, software, and services published or made available by us on iOS and Android platforms, including but not limited to Escape Prison Run and games utilizing gesture or voice control features (collectively, the “Apps” or “Services”).
By downloading, installing, accessing, or using any of our Apps, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, you must not download, install, or use the Apps.

PART I: USER AGREEMENT & TERMS OF SERVICE

1. Description of Services
Game Arts Entertainment provides mobile applications and games designed purely for entertainment purposes. Depending on the specific application you install, game mechanics and hardware utilization vary:
• Standard Applications (e.g., Escape Prison Run): These games offer classic mobile gameplay interfaces and do not access or use your device's camera, microphone, or any biometric sensors.
• Gesture & Voice-Controlled Applications: These games utilize your device's camera and microphone to enable interactive physical gesture and voice control features within the game.
2. User Responsibilities & Acceptable Use
By using our Services, you agree to comply with the following responsibilities:
• Permissions: For applications requiring camera or microphone features, you must grant the necessary permissions within your device operating system to fully utilize the gameplay. You can manage and toggle these permissions at any time through your device's system settings menu.
• Prohibited Conduct: You shall not misuse, exploit, copy, modify, or reverse-engineer the software, assets, or code of our Apps.
• Device Security: You are solely responsible for securing your mobile device and managing unauthorized access to your account.
3. Intellectual Property Rights
All rights, title, and interest in and to the Services including but not limited to software, artwork, characters, trademarks, and underlying game mechanics-are exclusively owned by Game Arts Entertainment. Unauthorized use, duplication, or reproduction of any game assets or intellectual property is strictly prohibited.
4. Termination and Suspension
We reserve the right to suspend or terminate your access to any or all of our Apps immediately, without prior notice or liability, if you violate any provision of this Agreement, fail to comply with applicable laws, or misuse our Services.

PART II: PRIVACY POLICY & DATA PRIVACY

5. Our Privacy Commitment
We respect your privacy and are committed to protecting it. Our studio strictly adheres to the principle of data minimization. We collect only what is necessary to run, optimize, and deliver our services, and we never sell personal data.
6. Hardware Access and Local Processing Protocol
We implement strict rules regarding sensitive hardware permissions:
• Camera & Microphone Access: Used exclusively in games that utilize gesture or voice controls. These permissions are completely disabled and never accessed in standard games like Escape Prison Run.
• 100% Local On-Device Processing: To ensure absolute privacy, all audio data and imagery captured by your microphone or camera is processed instantaneously and locally on your physical device. No audio or video data is ever transmitted to external cloud servers, nor is it stored or retained on your device after processing is complete.
• Biometrics & Health: In all Games, these are never accessed. We do not collect, read, or process biometric identifiers, health information, or physiological data.
• Precise Location (GPS): In all Games, this is never accessed. We do not track or store your precise real-time geographical coordinates.
7. Categories of Data We Process
We collect and process limited data across the following categories to facilitate and save your gameplay experience:
• Gameplay Data: Game progress history, including levels achieved, scores, and accomplishments.
• Preference Data: In-game toggles and configurations, such as sound settings, controls, and language choices.
• Account Data (Optional): If you choose to link or create an account via an external social platform, we may process your display name, full name, email address, avatar, and social login identifier to handle access management.
• Device & Performance Information: Non-personal technical data including your device type, operating system version, and general app performance metrics (such as logs or crash reports) to maintain stability.
8. In-App Purchases & Payment Processing
Our Apps may offer optional in-game shop items, such as a "no-ads" feature or cosmetic options. All financial transactions are initiated and securely handled directly by native platform stores (Google Play for Android or Apple App Store for iOS). Game Arts Entertainment does not collect or store credit card numbers, banking details, or payment credentials.
Upon a successful purchase, we receive a digital confirmation invoice containing transaction data (such as the item purchased, payment method used, and amount paid). We retain these digital invoice records under legitimate legal grounds:
1. To meet local tax, regulatory, and auditing requirements (Article 6(1)(c) GDPR).
2. To verify transactions and resolve billing disputes under our legitimate business interests (Article 6(1)(f) GDPR).
9. Advertising and Analytics (Third-Party Partners)
To support free versions of our games and analyze gameplay functionality, our Apps integrate third-party SDKs. These external services may process limited, non-personal data, such as device identifiers and approximate location metrics (limited to country/region level only) to handle campaign optimization and show local currency pricing.

10. GDPR Legal Basis for Processing
For users residing within the European Economic Area (EEA), we process personal data under the following provisions of the General Data Protection Regulation (GDPR):
• Consent (Art. 6(1)(a)): When you explicitly authorize account creation, device permissions, or platform link features.
• Performance of a Contract (Art. 6(1)(b)): When processing is strictly required to deliver underlying gameplay systems, cross-device game progress saves, or core interactive control mechanics.
• Legal Obligations (Art. 6(1)(c)): When retaining purchase receipts or transaction documentation to comply with financial auditing rules.
• Legitimate Interests (Art. 6(1)(f)): When analyzing anonymous performance metrics to secure our systems, prevent fraud, optimize marketing campaigns, and ensure overall stability.
11. Children's Privacy Compliance
Our Apps are general audience games and are not intended for or directed towards children under the age of 13. Users under the age of 16 must obtain verified consent from a parent or legal guardian to utilize our Services.
We fully comply with global child safety frameworks, including the Children's Online Privacy Protection Act (COPPA) and GDPR-K. Parents or guardians may contact us directly at any time to request access to, correction of, or immediate deletion of any data inadvertently collected from their child.

12. Security and Risk Acknowledgement

However, you acknowledge that no communication method over the internet or architecture of digital storage is 100% secure. While we actively strive to shield your information, we cannot guarantee its absolute security against malicious actors or hacking events.
13. Limitation of Liability
To the fullest extent permitted by applicable legislation, Game Arts Entertainment and its licensors shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, any loss of financial profits, data records, user goodwill, or software performance disruptions arising from:
1. Your direct access to, usage of, or absolute inability to utilize our Apps.
2. Any unauthorized access to or alteration of our secure servers or invoice logs.
3. Any malicious bugs, viruses, Trojan horses, or hacking scripts transmitted through our services by third parties.
4. The operational performance or failures of integrated third-party platforms, trackers, or advertising networks.
Your download and active use of Game Arts Entertainment applications are performed strictly at your own singular risk.
14. Indemnification
You agree to defend, indemnify, and hold harmless Game Arts Entertainment, its licensees, contractors, and corporate personnel from and against any and all claims, financial damages, losses, legal liabilities, costs, or procedural debts (including reasonable attorney fees) resulting from or directly arising out of (a) your use and access of the App by you or anyone using your device/account, or (b) an explicit breach of any legal terms outlined within this comprehensive Agreement.
15. Modifications to This Agreement
We reserve the right to amend or update this Agreement periodically. Material modifications will be communicated openly through in-app notices or updated platform marketplace banners. Your continued use of the Services following the posting of an updated terms version constitutes your binding legal acceptance of all modified terms.
16. Governing Law
This Agreement and all associated legal actions, disputes, or interpretations shall be governed by, construed, and enforced in accordance with the laws of the State of California, USA, without regard to conflict-of-law principles.
